BIOGRAPHY: NEW ENGLAND FAMILIES GENEALOGICAL AND MEMORIAL, The Emery line, pp 2353-4: John Em ery, was born 29 Sep 1598, the son of John Emery and Agnes (Northend), of Romsey, Jampshire , England. He sailed from Southampton 3 Apr 1635 with his brother Anthony and their families , in the ship "James," landing at Boston 3 Jun 1635. He moved to Newbury, where he was made f reeman 2 Jun 1641.

He was prominent in several religious controversies of the time. On March 16, 1663, he was br ought to court and fined for entertaining travellers and Quakers, He was also prominent in th e case of Lt. Robert Pike, who in 1692 appeared in opposition to the witchcraft delusion, Eme ry favoring Pike's side, and he was in the Woodman faction in the ecclesiastical difficultie s of 1669 and 1670.

He was evidently respected and prominent in spite of his decided religious views. He served a s selectman.

Marriage to Mary SHATSWELL: (1,6,12) 29 Oct 1650. (1) Newbury, Essex Co., MA. (2,3,4,6,10, 11 ) Mary, widow of John WEBSTER of Ipswich, MA. (2) There is some question as to the date of ma rriage, whether it is the marriage of this John to Mrs. Mary WEBSTER, or his son John to Mis s Mary WEBSTER. Ipswich, MA vital records contain no entry for this marriage. The original Ne wbury record reads, "John EMERY m. Mary WEBSTER, Oct. __." The date just before is 1648, an d the one just after is 1651. The Newbury town copy inserts "wid. John of Ip." and "29, 1 650 ." It looks as if the date of marriage for this John Sr., 29 Oct 1650, and the date of marria ge for his son John, 2 Oct 1648, are different interpretations of the one original record "Oc t __." The age of John Jr. and the date of birth of his first child (24 Jun 1652) render 165 0 or 1651 a more probable date for this marriage. 1648 is a probable date for John Sr. ( 3a ) Only one EMERY-WEBSTER marriage took place, namely John EMERY and Mary (SHATSWELL) WEBSTER , widow of John WEBSTER. (7b) Alice GRANTHAM, his 1st wife, d. 28 Apr 1649. (8,10) His 1st wi fe possibly dead by 1646, when he was fined for his attentions to the wife of Henry TRAVER S . (8) 2 Oct 1648. Some sources say 1647. Hadley, Hampshire Co., MA. (9) (10) Probably 1647 , a year after her first husband's death and when John EMERY's bond in the TRAVERS case was d ischarged. It is my belief that the original Newbury record, which now reads "John EMERY an d Mary WEBSTER, Oct.," was legible when Henry SHORT made the "town copy" in 1690, that he cor rectly copied the date October 29, 1650, but, having in mind the bride's mother's wedding, mi stakenly added "wid. John of Ipswich" to the record of the marriage of John EMERY Jr. and hi s step-sister, Mary WEBSTER, the names of the bride and groom of the (1647?) ceremony being i dentical with those of their children who were united in the 1650 ceremony. (11) The marriag e record in Newbury of John EMERY and Mary WEBSTER is given as 29 Oct 1650 and in a town copy , made by the clerk Henry SHORT in 1690, to this entry was added by him, after her name, "wid . John of Ipswich." This is wrong because court records show that John EMERY Sr. married wido w Mary WEBSTER by 1647. [NOTE: John Sr.'s daughter Ebenezer "Eben" was b. 16 Sep 1648. If h e married Mary on 2 Oct 1648, he would have been marrying her either just a few days after hi s 1st wife's death, or Eben was born out of wedlock to the 2nd wife. Since Eben's birth is s o much later than John EMERY's other children - youngest daughter Anna was born 1632 and a pe riod of about 16 years elapses before Eben's birth - it would seem that John Sr.'s marriage t o Mary SHATSWELL was at the latest in early 1648, and Eben was their daughter. However, Mar y (SHATSWELL) (WEBSTER) EMERY does not name Ebenezer as one of her children in her will dt d 1 693, nor does she leave any bequest to any of Ebenezer's children, although she leaves be quests to other sons and daughters. However, if Eben's death date of 1694 is in error, and sh e may have been deceased, or perhaps the abstract given in source 4 leaves out her name, or t he will was changed before it was proved in 1696. Need to look at the original records o r a transcript.]

(2) When the inhabitants of Salisbury, Hampston, Newbury, Haverhill and Andover pet itioned the General Court to revoke the sentence against Robert PIKE, the Court resented th e matter so deeply that most of the signers apologized. Samuel HALL, Philip CHALLIS, Josep h FLETCHER, Andrew GREELEY, and George MARTIN of Salisbury; John EMERY Sr. of Newbury, an d 9 others who insisted on the right of petition had "not given satisfaction," and were requi red to give bonds and "answers for their offense before the County Courts." (5) The General C ourt chose a committee to call the signers of the PIKE petitions from the several towns toget her to ascertain their reasons for signing the petition. The committee visited the towns an d held sessions, calling upon the offenders to appear before them and justify their conduct . He was among those who asserted their right to petition whenever they saw fit, and denied t he right of anybody to interfere. (12) He was prominent in the case of Lt. Robert PIKE, refus ing to recognize the authority of the Court to deprive him and his neighbors of the right o f petition.

*************John sailed from Southampton, England 3 or 5 April 1635, with his brother Anthon y in the James of London, William Cooper, Master, three hundred tons, carrying passengers an d cattle. They arrived 3 June 1635. Winthrop calls her master "Mr. Graves" and says that h e "had come every year for these seven years". The passenger list includes: John Emery, 34 o f Romsey, county Hants, carpenter, Newbury; Mrs. Emery; Anne Emery; Elinor Emery; John Emery.

He was made freeman 2 July 1641. He settled at Newbury MA, where he was a selectman, fe nce viewer, and served on the trial and grand juries. In 1655 he was Constable of the town a nd later clerk of the market. He was a carpenter by trade, and kept the ordinary.

In 1663 either John Emery Sr. or John Emory Jr. was convicted of hospitality to the Quak ers.

In 1671 he was aged 73. In Newbury in 1677 when he took the oath of allegiance, John Em ery Sr. was aged 80.

The will of John Emery Sr. is dated 11 May 1680, proved 27 November 1683. He appears t o have had some agreement with the children of his first wife, since he leaves the major par t of his estate to the children by his second wife, Mary (Shatswell) Webster. He bequeathe d to wife Mary, daughter benezer Hoag, son Jonathan, and the residue divisible among his si x children and grandchild Mary Emerson, his grandchild; sons Jonathan E. and Abraham Merrill , overseers. The inventory amounted to D263.

John of Ip." and "29, 1650." It looks as if the date of marriage for John Sr., 29 Oc t 1650, and the date of marriage for this John Jr., 2 Oct 1648, are different interpretation s of the one original record "Oct __." The age of John Jr. and the date of birth of his firs t child (24 Jun 1652) render 1650 or 1651 a more probable date for this marriage. (2a ) Onl y one EMERY-WEBSTER marriage took place, namely John EMERY and Mary (SHATSWELL) WEBSTER, wido w of John WEBSTER. (7) It is my belief that the original Newbury record, which now reads "Joh n EMERY and Mary WEBSTER, Oct.," was legible when Henry SHORT made the "town copy" in 1690, t hat he correctly copied the date October 29, 1650, but, having in mind the bride's mother's w edding, mistakenly added "wid. John of Ipswich" to the record of the marriage of John EMERY J r. and his step-sister, Mary WEBSTER, the names of the bride and groom of the (1647?)
