Mary Brown, of Sudbury, about 1662, and resided there. May 23, 1685, Benjamin Rice, of Sudbury, sued Dr. William Avery, of Boston, for malpractice. Verdict for defendant. In that suit, Daniel Pond testified that, "ten years ago, Benjamin Rice, of Sudbury, came to my house, in Dedham, with his feet frozen, and lodged there. Dr. William Avery's son, Benjamin, cut off one foot at the lowest joint, and stanched the blood with a musquash skin." Dr. William Avery does not appear, by the evidence in the case, to have been present at the operation. The malpractice, if any, was therefore not chargeable to him, but to his son, Benjamin:- hence the verdict. D. in 74th yr. One child.

A boulder with a bronze tablet was also erected by the Association and it marks Edmund's homestead, on the Old Connecticut Path in Wayland. Edmund married in st. History of the Town of Marlborough, Hudson, 1862, p. 431 As the Rices were one of the earliest, so they have been one of the most numerous families in the town -- ranking with the Howes and Brighams, and like them sending out emigrants to many other towns. If either of these families had retained all their descendants within the township, the population would have increased more rapidly than it has, though there had been no other family in the place. Edmund Rice, b. about 1594, came from Barkhamstead, Hertfordshire, England, and settled in Sudbury in 1639. He was a prominent man in Sudbury; was one of the selectmen, or townsmen, as they were frequently denominated, and was one of the Deacons of the Church. He was honored with several appointments by the General Court, and was denominated therein "Goodman Rice." He was appointed to solemnize marriages in Marl., and enjoyed the confidence of his fellow citizens in both towns. He was one of the petitioners for the grant which was afterwards made the town of Marl., and moved to the place. His wife Tamazine, d. in Sudbury, June 13, 1654, and he m. as a 2nd wife, Mercie, wid. of Thomas Brigham, the ancestor of the numerous Brighams which afterwards settled at Marl. He m. Mercie, March 1, 1635, and d. at Marl. May 3, 1663, and was buried at Sudbury. His wid. m. 1664, William Hunt, of Marl., an early settler of Concord. He d. at Marl., 1667, and his wid. d. Dec. 28, 1693. Edmund Rice came to Marl. soon after the grant of the township, and took up his abode on what is known as the "great road," on the northerly side of the Pond, not far from the Williams Tavern. ****** Edmund Rice Association - Deacon Edmund Rice1,2 (M) Deacon Edmund Rice was a Selectman in 1644 and subsequent years; a Deacon of the church in 1648, and, in 1656, one of the petitioners for a new plantation that became known as Marlborough at Sudbury, MA.10 He was designated a freeman on 13 May 1640 at Massachusetts.11 He became Deacon of the Church at Sudbury, MA, in 1648.8 He was a deputy to the General Court of the Massachusetts Bay Colony (the Massachusetts legislature) representing the Town of Sudbury, serving on 27 May 1652, 18 May 1653, and 3 May 1654 between 1652 and 1654 at Boston, MA.12 He resided after 1656 at Marlborough, MA, lived on "The Great Road" on the northerly side of the pond (Cochituate Pond), not far from Williams Tavern. Records:- Mathew Rice, one of the admrs., was the only surviving son, in 1714, of Edmund, Sen; and Isaac Rice, the other admr., was son of Mathew; and all those receipting were gr. chil. of Edmund Rice, Sen. Those lands probably accrued from rights in lands in which Edmun Rice, Sen., had an interest, but undivided in his life-time.

Joyce, dau. of William and Martha Russell of Cambridge, and resided in the south-easterly part of what is now Wayland, by "the spring'" and near his brother John Rice. He was deacon of Sud. church, and in 1707 represented that town in the General Court. "At the request of Mr. John Rice and Deacon Edmund Rice, we have stated a way from John Rice's house by the southerly side of Deacon Edmund's house to THE SPRING. May 10, 1710." Jason was restricted from selling in the lifetime of his father. This deed was witnessed by Daniel Hastings, William Rice and John Sherman. Dea. Edmund Rice d. in his 66th year, and only 19 days after his brother John. Inventory of his estate, #451.1.0, taken Nov. 19, 1719, by Jonathan Rice, Richard Parks and Edward Sherman. We do not learn what became of his widow. Her father, William Russell, d. FEb. 4, 1661; and her mother, Martha, m. a Hall, and survived him. Her son-in-law, Edmund Rice, settled her estate. Nov. 24, 1719, Samuel Abbot and Jyce, his wife; Joseph Parmenter and Lydia, his wife, and William Rice and Martha, his wife, "convey all our right to Hon'd father, Edmund Rice's estate in Sudbury or elsewhere to our brother, Jason Rice.
