"I also know that «u»«b»John Ball Melton, Sr«/u»«/b». was probably named for a friend of William Melton's, Col. James Ball." Col. James Ball, Jr., commonly called "The Young Colonel of Bewdley," Lancaster County, was the son of Maj. James Ball and his second wife, Mary Conway Daingerfield. He was born Dec. 31, 1718. He married (first) --- (this marriage is recorded in the charts, but the name is not given); (second) Mildred ---, whose family name is not known; (third) in 1753, Lettice Lee, daughter of Richard Lee and his wife Miss Silk. Col. Ball was burgess from Lancaster County, 1755, resigning that year to accept the office of sheriff. Colonel Ball was a vestryman of St. Stephen's Parish, Northumberland County, 1744-1789. In 1745, he was elected church warden when James Ball, Sr. was in the vestry. He was frequently church warden, and July 22, 1785, elected treasurer. He was with Col. Thomas Gaskins, executor of Maj. Peter Conway's estate. For many years, he was a delegate, and in 1788, a member of the Virginia Convention.
IV--Burgesses and Other Prominent Persons
Major James Ball of "Bewdley," Lancaster County, was son of Capt. William Ball and his second wife, Miss Harris of Northumberland. He was born 1678. He was burgess from Lancaster County in the assemblies of 1715, 1718, 1720-22, in the session of May 18, 1732, and in the assembly of 1736-1740. He married (first) July 15, 1699, Eliza Howson, died Jan. 22, 1704-05, probably daughter of Leonard Howson. He married (secondly) April 16, 17--, Mary Conway Daingerfield, daughter of Col. Edwin Conway, and widow of John Daingerfield. She died Sept. 15, 1730. He married (thirdly) April 25, 1742, Mary Ann (Bertrand) Ballendine, daughter of Rev. John Bertrand of Rappahannock County, and widow of Capt. William Ballendine.
Maj. Ball was a vestryman of Christ Church, Lancaster County, and church ward en 1743. In 1740, he and Mr. Joseph Ball were allowed to build a gallery in White Chapel Church for their families, provided that it be completed at the same time with the church and furnished in the same style as the west gallery. He died Oct. 13, 1754. His will was dated July 15, 1754, probated Lancaster County, Nov. 15, 1754. [NEED TO DEFINE SENTENCE:General Notes]3469 Our John Ball Melton, Sr. (son of William (02) Samuel Melton) was known as John Jr. when he was growing up, to distiguish him from the John Melton who married Sarah, daughter of William Samuel Melton). Consequently, some people have mixed the two lives together. Hopefully, our family group will be able to untangle them.
The wife of John (01) Ball Melton, Sr. remains under dispute. Some say that her name was Lydia, some say it was Patsy. It's going to take some work to prove which one is correct. Maybe he married twice and both are correct. If anyone has a legal document or family record proving John's wife, please let us know. Be it remembered that on the 10th day of July A.D. 1867, the above plaintiffs by S. K. Wolfe Esq., attorney, filed in the office of the Clerk of the Court of Common Pleas, within and for the county of Harrison and state of Indiana, their petition in the above entitled cause, in the words and figures following to-wit:
In the Harrison Court of Common Please, August term, 1867, Harrison County, Indiana: Isaac Melton, Elias Melton, Andrew J. Melton, John H. Melton, Nathan G. Melton, and Anthony Robinson complain of George W. Melton, Susan Parker and Robert Parker her husband, John H. Melton Jr., Mary Elizabeth Melton, Robert A. Melton, Margaret L. Melton, Solomon C., D. Melton, Elizabeth Rhodes and Daniel Rhodes her husband, and Mary Jane Kinter, and says that heretofore, to-wit:
On the 11th day of September 1865, John B. Melton departed this life intestate, the owner by legal title in fee of the real estate lyin in Harrison County, Indiana, described as follows, to-wit:
(1) A part of the the northwest quarter of Section Four in Township Four South, and in Range Three East, bounded as follows: Beginning on the West Line of said quarter section, eighty (80) yards north of the southwest corner thereof, running thence north 84 degrees east 39 poles: thence south 16 degrees east 167 poles: thence south 40 degrees east 10 poles: then south south 30 1/2 degrees east 29 poles: then south 45 degrees east 6 poles: then south 38 3/4 degrees east 31 poles to the south line of said quarter section: thence east with said south line 9 poles to the sourthwest corner of . . . (2) . . . of section thirty-three (33) in Township Three (3) South, and Range Three (3) East, and being all of said quarter section except 7 1/4 acres sold out of the northeast corner thereof by John B. Melton & wife by and bearing date April 5, 1853 to Christopher Heft, leaving 32 2/4 acres more or less:
(3) Also, the southwest fourth of the southwest quarter of Section 33 in Township Three (3) South and Range Three (3) East, containing 40 acres more or less:
(4) Also ten acres off the south end (in a parallel line running east & west) of the northwest fourth of said southwest quarter of said Section Thirtythree (33) in Township Three (3) South and Range Three (3) East, all of said tracts containing in the aggregate 179 1/4 acres more or less.
And the plaintiffs further say that said John B. Melton, at the time of his death, left as his heirs and only heirs at law, the following named childred and grandchildren to-wit: said plaintiffs and a daughter Elizabeth Conrad, wife of Valentine Conrad:
Also said defendants George W. Melton, Susan Parker, John H. Melton Jr., Mary E. Melton, Robert E. Melton, Margaret J. Melton, and Solomon Melton who are the children and said plaintiff Anthony Robinson a grandchild, and only heirs at law of Robert Melton, said John B's son who died intestate before his said father to wit, on the 3rd day of May 1849, leaving said children as his only issue:
Also said defendants Elizabeth Rhodes and Mary Jane Kinter, who are the children and only issue of said John B's deceased daughter, Sarah Kinter, who died before her father.
Said plantiffs would further show that said said plaintiffs Nathan G. Melton has purchased and is now the owner by legal title, to full of share of the said Elizabeth Conrad by and from her husband (Valentine Conrad).
Said plaintiffs therefore charge that said plaintiffs and said defendants are the owners by legal title in fee and tenants in common of said land and entitled to shares thereof as follows:
